Traffic Camera Caught Your Rental Car: Who Gets the Fine?

You returned the vehicle three weeks ago.

The trip is over. The rental agreement is probably somewhere among your travel documents. You may no longer even remember the registration number of the car.

Then a message arrives from the rental company.

A traffic camera recorded an incident while the vehicle was in your possession.

The first question is usually not:

“How much is the fine?”

It is:

How can a traffic fine reach me when the car does not belong to me?

With a rental vehicle, there is an additional step that does not normally exist when you drive your own car.

The camera identifies the vehicle. The relevant procedure must then establish who was driving it at the particular date and time.

That is why you may hear about the incident days or even weeks after returning the keys.

This guide explains what can happen after a rental car is recorded by a traffic camera in Serbia, how the rental period can be linked to a particular driver and why you should not delete your rental agreement as soon as the trip is over.

1) A Traffic Camera Sees the Vehicle, Not Your Rental Agreement

An automated traffic system does not know that the car has been rented.

It records information connected with the vehicle and the event, including the registration plate where applicable.

The vehicle records, however, are connected with the registered owner or user, not automatically with the tourist or business traveller who rented the car that day.

With a rental car, this means that the owner or registered user of the vehicle, potentially the rental company, may become part of the identification process.

Only then does the question arise:

Who was actually driving at that particular time?

Under Serbia’s Road Traffic Safety Law, when requested by a police officer, the owner or user of a vehicle must provide complete and accurate information identifying the person who was allowed to drive it at the relevant time, together with the required evidence.

This is one reason your rental agreement is more than a document showing the price and return date.

It creates a record of who had the vehicle and during which period.

2) How Is the Driver of a Rental Car Identified?

Consider a simple example.

You rent a vehicle from 12 August until 16 August.

An event involving that vehicle is recorded on 14 August at 6:42 PM.

The rental company can check its records to determine who had possession of the vehicle during that period and which drivers were included in the rental agreement.

This is also why every additional driver should be properly declared.

There is an important distinction:

the person who booked the rental and the person actually driving at the time of an offence are not necessarily the same person.

3) Does the Traffic Fine Automatically Go to the Rental Company?

Not every case follows one identical route, so it would be misleading to say that “all traffic fines first go to the rental company”.

The process depends on the type of offence, how it was detected and the official procedure that applies.

Where an offence was recorded without the driver being stopped immediately, the owner or user of the vehicle may need to provide information about who was driving.

Serbia’s official eGovernment portal even provides a service for declaring who was driving a vehicle at the time of a traffic offence.

For a rental vehicle, the rental company has records connecting the car with a specific rental period and authorised drivers.

That is why receiving a message from HAS Rent a Car after the vehicle has already been returned should not automatically surprise you.

It does not mean that the rental company issued the fine.

It means that the vehicle, date and time may need to be linked to the person who was using it.

4) Why Can a Traffic Fine Appear Weeks After the Rental Ended?

When a police officer stops you on the road, you immediately know that something has happened.

An automatically recorded event is different.

You continue driving.

You return the vehicle.

You fly home or continue your trip.

Only afterwards may the administrative process continue.

The recorded information may need to be processed, the vehicle identified, its owner or user contacted and, where required, the driver established.

This is why:

“I returned the rental car without any problems”

does not necessarily mean that you cannot receive information later about something that happened while you were driving it.

This is particularly important for international visitors who have already left Serbia.

Keep the email address and phone number used for your reservation active and do not ignore communication from the rental company simply because your trip has ended.

5) Who Actually Pays a Rental Car Traffic Fine?

The simplest principle is:

driving a rental car does not automatically transfer a driver’s traffic offence to the rental company.

Where the relevant procedure determines that you were driving when an offence occurred, the fact that the vehicle belongs to a rental company does not by itself remove your responsibility.

The wrong assumption is:

“The car was not mine, so the fine cannot be mine.”

At the same time, you should not assume that every notice associated with a vehicle automatically proves that you committed the offence.

The date, exact time, registration plate, rental agreement, authorised drivers and official document all matter.

6) What If Two Drivers Were Listed on the Rental Agreement?

This is where memory can become unreliable.

The reservation may be in your name, but another authorised driver may have been behind the wheel at the relevant time.

When the rental company asks who was driving, do not answer based only on who booked the car.

First check:

• the exact date, time, location and registration number connected with the event

• travel messages, photographs, parking receipts, fuel receipts or location information that may help establish who was driving

• the rental agreement and all drivers who were officially included
  

Serbian law requires complete and accurate information when the owner or user is formally asked to identify the driver, so guessing because the trip happened weeks ago is not a good approach.

7) What If You Cannot Remember Who Was Driving?

Do not invent an answer.

Do not automatically name the person whose name appears first on the booking.

Ask the rental company for the information available in the notice, particularly the exact date, time, location and vehicle registration number.

Then reconstruct that part of the journey.

A time-stamped photograph, restaurant receipt, parking confirmation, fuel receipt or location history may help you determine who was using the vehicle.

Serbia’s Road Traffic Safety Law requires the owner or user, when formally requested by the police, to provide complete and accurate information identifying the person who was allowed to drive the vehicle at that time.

Accurate records are therefore much more useful than assumptions.

8) Speeding Is Not the Only Reason a Rental Car May Be Recorded

When travellers hear the words “traffic camera”, they usually think about speeding.

However, the important lesson is broader than one specific type of offence.

Different traffic offences can be detected and processed in different ways.

The principle to remember is:

the registration number identifies the vehicle, while the relevant procedure determines the responsible person in the particular case.

9) A Parking Charge and a Traffic Fine Are Not Necessarily the Same Thing

Another common mistake is using the phrase “traffic fine” for every charge associated with a registration plate.

Parking systems operate under their own rules and procedures.

A problem caused by unpaid zoned parking does not necessarily follow the same procedure as a road traffic offence recorded by an automated camera.

Always read the document and identify who issued it.

Do not make a payment simply because someone mentions your rental car’s registration number.

10) What Should You Do When the Rental Company Contacts You?

Your first reaction should be neither panic nor argument.

Ask for the relevant details.

You need to know which vehicle is involved, the date and time of the event and what action is actually required from you.

Then compare those details with your rental agreement.

When the time falls within your rental period and you were the driver, follow the instructions contained in the official document and any procedural information provided by the rental company.

When something does not match, for example the vehicle had already been returned, tell the rental company immediately and provide evidence.

Do not ignore deadlines.

Official notices and procedures may contain specific time limits for responding or taking another action.

11) Can You Check Traffic Offences Online in Serbia?

Registered users of Serbia’s eGovernment portal can use the official Traffic Offences Overview.

The service allows eligible users to view current and completed traffic offences, together with information such as penalty points and possible driving bans.

Access requires the appropriate electronic identification.

For a foreign visitor, this service may not always be practical or accessible, which makes communication with the rental company and careful reading of the official notice particularly important.

If you have already left Serbia, continue checking the email address and phone number used for your reservation.

12) Can the Rental Company Simply Take a Fine From Your Deposit?

Do not assume how a particular rental company will administratively handle every possible situation.

Deposits, insurance, user responsibilities and rental procedures are governed by the rental agreement and applicable terms.

13) Why Should You Keep the Rental Agreement After Returning the Car?

Many travellers photograph the agreement at pickup and delete it as soon as they return the keys.

Keeping it for longer is a better idea.

Your agreement can help establish:

• the exact beginning and end of the rental period and the registration number of the vehicle

• the primary driver and any additional authorised drivers

• the responsibilities and conditions accepted when the vehicle was collected

14) What If the Camera Recorded the Vehicle After You Returned It?

This is why you should not automatically accept responsibility for every notice simply because you previously rented that vehicle.

Compare the exact time of the event with the recorded return time.

When the event occurred after the rental ended, send the rental company your agreement or other proof showing when the vehicle was returned.

The same principle applies when an event was recorded before you collected the car.

Accurate timestamps protect both the customer and the rental company from connecting an event with the wrong rental period.

15) What If You Have Already Left Serbia?

Leaving Serbia does not mean that you should ignore the message.

Ask the rental company for the details or a copy of the relevant document and establish exactly what is required.

Do not automatically send money based only on an informal message that you do not understand.

At the same time, do not disregard official correspondence merely because your trip has ended.

When a formal procedure requires a statement or another action, the relevant deadline is not determined by whether you are still on holiday in Serbia.

16) How Can You Reduce the Chance of Receiving This Message at All?

Do not drive according to the speed of the vehicle in front of you.

Watch the signs.

Pay attention when speed limits change.

Do not assume that your navigation app always reflects the latest traffic arrangement.

When you do not know the city, position yourself in the correct lane early rather than making a sudden manoeuvre at the last moment.
